PRINCIPLE OF STRICT LIABILITY IN CRIMINAL LAW: AN INDIAN PERSPECTIVE

Abstract :

Liability is an inherent feature of human society. Rights are always followed by liabilities. Without the existence of liability in our society, the coherence of our society will also loose its force, and people would not care and value other‘s rights even.Now coming to the concept of criminal law, the liability for one’s actions is based on two elements, i.e. actus reus and mens rea. However the principle of strict liability is an exception to this.The author in this paper has elaboratedupon thisprinciple and has even discussed about its various instancesin the Indian Penal Code, 1860 and other statutory provisions.
